Privacy Policy

HIPAA RIGHTS FOR GENESIS CLIENTS

  • To be informed of and receive a copy of my CLIENT RIGHTS:
  • Right to receive services regardless of race, sex, creed, color, physical or mental handicap;
  • Right to know the reasons for and or purpose of the services provided;
  • Right to grieve any decision(s) made concerning my course of treatment. The Grievance is listed on my client rights and grievance document;
  • Right to be informed of initial assessment finding and discuss with a clinician the possible treatment methods available to me including benefits and possible risks at intake;
  • Right to receive Orientation to Treatment during my Intake so I can understand the treatment process;
  • Right to receive age-appropriate services; and
  • Right to know our treatment services do protect your civil rights and do not involve corporal punishment.
  • Right To Get A List Of Disclosures: You have the right to ask for a list of certain disclosures. You must make the request in writing. The list will not include the times that information was disclosed for treatment, payment, or health care operations. The list will not include information provided directly to you or your family or information sent with your authorization.
  • Right To Receive A Copy Of The Notice Of Privacy Practices And Any Revisions Thereafter: You have the right to receive a copy of our Notice of Privacy Practices and any revisions made thereafter. The terms of this notice may be changed in the future, and these changes will be posted in the waiting room and in the Client Handbook. You may also request a copy of the new Notice by contacting the Privacy Officer Daphne Houghton at 704-720-7770.

You may file a complaint about our Privacy Procedures:

If you believe that your privacy rights have been violated or if you are dissatisfied with our privacy policies and procedures, you may file a complaint either with us or with the federal government. We will not take any action against you or change our treatment of you in any way a complaint is filed.

  • To file a complaint with the agency, you may bring your complaint to any agency location, or you may contact the Privacy Officer at: Daphne Houghton, Genesis… A New Beginning, 704-720-7770.
  • To file a complaint with the Federal Government, you may send a written complaint to: Atlanta Federal Center, Region IV, Suite 3B70, 61 Forsyth Street, S.W., Atlanta, GA 30303-8909. You may call 404-562- 7886.
The right to confidentiality under Federal confidentiality rules (45 C.F.R. Parts 160 and 164 - the “Privacy Standards” and 42 C.F.R. Part 2).
  1. Federal law and regulations protect the confidentiality of client records maintained by GENESIS. We may not
    say to a person outside the agency that you participate in services, or disclose any information identifying you
    as an alcohol or drug abuser or mental health client unless:
  • you consent in writing; or
  • you threaten to hurt self or someone else; or
  • the disclosure is allowed by a court order, with a subpoena, specifically authorizing disclosure; or
  • the disclosure is made to medical personnel in a medical emergency; or
  • the disclosure is made to qualified personnel for research, audit or program evaluation (NC TOPPS); or
  • you commit or threaten to commit a crime either at the agency or against any person who works for the agency;
  1. Federal laws and regulations do not protect any information about suspected child or elder abuse or neglect
    from being reported under State law to appropriate State or local authorities.
  2. GENESIS has the right to search anyone if there is reasonable cause to believe that person has violated the possession of drugs/alcohol policy.
  3. The above Federal Laws do not protect my information if I am being investigated under the 2002 Patriot’s Act.
